It is easy to forget that all this happened in just a year because it truly was a lot &#8211; hence below is a summary of three key trends shaping innovative lawyering, legal design, legal tech, and legal education sphere.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">We will take a look at Generative AI (of course), how legal education has been putting up with the rollercoaster, and how legal design may be slowly but surely coming of age.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2023 was the year when a lot of lawyers were freaking out about Generative AI<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Although the ChatGPT was widely available for tinkering as of the end of 2022, it felt like there was a full attack on the castle as of 2023.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Here is a little tour of headlines,<\/strong> just to underscore how much has happened in a year:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4314839\">GPT 3.5 took the US Bar Exam and failed<\/a> (lawyers sigh with relief),<\/li>\n\n\n\n<li><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4389233\">GPT4 successfully took the US Bar Exam and scored in the 90th percentile<\/a> (lawyers are panicking),<\/li>\n\n\n\n<li><a href=\"https:\/\/www.goldmansachs.com\/intelligence\/pages\/top-of-mind\/generative-ai-hype-or-truly-transformative\/report.pdf\">An explosive Goldman Sachs Report estimated that 44% of legal work could be automated,<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.reuters.com\/markets\/deals\/thomson-reuters-acquire-legal-tech-provider-casetext-650-mln-2023-06-27\/\">Thomson Reuters acquired the legal AI assistant Casetext for a whooping $650m amidst somehow slower legal tech M&amp;A activity,<\/a><\/li>\n\n\n\n<li>Harvey, the law-trained GPT became a household name in law firms and secured hefty <a href=\"https:\/\/www.sequoiacap.com\/article\/partnering-with-harvey-putting-llms-to-work\/\">Series A<\/a> a <a href=\"https:\/\/www.harvey.ai\/blog\/series-b\">Series B<\/a>\u2002investment rounds,<\/li>\n\n\n\n<li><a href=\"https:\/\/www.allenovery.com\/en-gb\/global\/news-and-insights\/news\/ao-announces-exclusive-launch-partnership-with-harvey\">Allen&amp;Overy broke the legal internet with their bombshell announcement that they have actually been using Harvey for a while already,<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.dentons.com\/en\/about-dentons\/news-events-and-awards\/news\/2023\/august\/dentons-to-launch-client-secure-version-of-chatgpt\">Dentons announced a client-secure version of ChatGPT,<\/a><\/li>\n\n\n\n<li><a href=\"https:\/\/www.nytimes.com\/2023\/06\/08\/nyregion\/lawyer-chatgpt-sanctions.html\">A lawyer got caught citing fake cases supplemented by ChatGPT before Federal Court<\/a>,<\/li>\n\n\n\n<li><a href=\"https:\/\/support.ironcladapp.com\/hc\/en-us\/articles\/12947738534935-Ironclad-AI-Overview\">Ironclad launched AI Assist powered features<\/a> (alongside <a href=\"https:\/\/www.legaltechnologyhub.com\/contents\/the-use-of-large-language-models-in-legaltech\/\">basically every other app imaginable<\/a>),<\/li>\n\n\n\n<li><a href=\"https:\/\/www.mishcon.com\/news\/mishcon-de-reyas-exploration-of-ai-technologies-featured-in-the-media\">Mishcon de Reya was hiring for a Legal Prompt Engineer<\/a>,<\/li>\n\n\n\n<li><a href=\"https:\/\/www.luminance.com\/news\/press\/20231107_luminance_showcases.html\">Luminance Showcased World\u2019s First Completely AI-Powered Contract Negotiation<\/a>,<\/li>\n\n\n\n<li><a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/headlines\/society\/20230601STO93804\/eu-ai-act-first-regulation-on-artificial-intelligence\">EU has been doing its procedural magic while working on the AI act<\/a>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">It was (and is) hype left and right, with an abundance of prompt engineering online courses, thought leadership, and a huge heap of existential angst. We learned words such as <em>hallucinate<\/em>, bossed our own <em>GPTs<\/em>, and kept on hearing stuff like &#8220;<em>AI will not replace lawyers, lawyers using AI will<\/em>&#8221; and &#8220;<em>did you know that this text was actually generated by ChatGPT<\/em>&#8221; over and over again. Lawyers briefly stopped correcting each other to poke holes into generated answers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.linkedin.com\/posts\/kerry-westland-78aa662b_genai-innovation-legaltech-activity-7127292127213936641-nBbU\/?utm_source=share&amp;utm_medium=member_desktop\">The legal world was searching for use cases<\/a> &#8211; <em>any use cases<\/em> (<a href=\"https:\/\/www.linkedin.com\/posts\/barboraobracajova_can-gpt-review-my-ndas-during-the-weekend-activity-7056971026827464705-nYS2?utm_source=share&amp;utm_medium=member_desktop\">including the NDA reviewer we prototyped at the Prague AI Hackathon<\/a>). The culture around trying new and unexpected experiments with the technology somehow reminded me of the early days of the lockdown, when everyone started to bake over-the-top bread.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By the end of the year, it felt like some were already falling into the trough of disillusionment. Some started to realize that <strong>it is really hard to use AI sensibly and safely if you do not have well-managed and accessible data and appropriate safeguards<\/strong>, and a lot of the benefit lies beyond the somewhat familiar chat window.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps wide, reasonable, and measured use of Generative AI in law will be in the books for next year. Or the one after that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Let&#8217;s just hope we don&#8217;t stop asking <a href=\"https:\/\/www.linkedin.com\/posts\/barboraobracajova_a-couple-of-hard-questions-around-ai-in-law-activity-7125478493772992512-hJ-P?utm_source=share&amp;utm_medium=member_desktop\">the hard questions<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal Education got into the spotlight<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The advancements in Generative AI put law schools in a somewhat peculiar position as well.<strong> If a machine can pass the Bar Exam that is at least on paper supposed to prove the aptitude of lawyers, (a) the test is either nothing but a technocratic act of gatekeeping or (b) lawyers can be indeed made obsolete by the daring GPT.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The solution to (a) will take a lot more time, as it is between deregulation and better tests &#8211; and I don&#8217;t think that the bar exams are going to become any more reflective of the reality of legal practice any time soon. Turning to (b): <a href=\"https:\/\/attorneyatcode.com\/cs\/lawyer-skills-ai\/\">there was a lot of talk about what skills will be necessary for the future generation to thrive if all the grind is taken up by the machine<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.law.com\/americanlawyer\/2023\/05\/10\/gen-z-less-interested-in-big-law-and-traditional-law-firm-paths\/\">That is if the newcomers choose to practice law, at all. <\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ultimately, empathy, human skills, and legal design seem to be winning the skills debate, and the number of design-oriented programs is on a slow rise, as evidenced <a href=\"https:\/\/heyzine.com\/flip-book\/a6309af5d4.html#page\/1\">by this list by the Legal Design Desk<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One step further, some universities are keen to surf the Generative AI wave: Cat Moon and Mark Williams started the <a href=\"https:\/\/law.vanderbilt.edu\/vanderbilt-law-school-announces-creation-of-ai-law-lab\/\">Vanderbilt University Artificial Intelligence Law Lab<\/a>. Josh Kubicki, formerly of the University of Richmond School of Law has taken over the steering wheel of the Generative AI debate with his <a href=\"https:\/\/thebrainyacts.beehiiv.com\/subscribe?ref=JqDJyxh6ut\">Brainyacts newsletter<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/news.bloomberglaw.com\/business-and-practice\/chatgpt-on-campus-law-schools-wrestle-with-emerging-ai-tools\">All that happening while universities are navigating how to deal with GPT-induced plagiarism<\/a> (and experimenting with how to keep essays relevant), <a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/headlines\/society\/20230601STO93804\/eu-ai-act-first-regulation-on-artificial-intelligence\">debates if GPTs should be invited to or banned from the classrooms<\/a>a <a href=\"https:\/\/www.law.berkeley.edu\/library\/legal-research\/chatgpt\/\">trying to help teachers and educators stay on top of all the many new developments in order to keep up with the digital native Gen Z<\/a>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Needless to say these trembles were felt elsewhere both outside and inside the legal market. Even <a href=\"https:\/\/www.linkedin.com\/posts\/barboraobracajova_generativeai-activity-7128392118326243329-hP_t?utm_source=share&amp;utm_medium=member_desktop\">L&amp;D professionals were experiencing similar struggles.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Charles University, we did two full semesters of <a href=\"https:\/\/www.linkedin.com\/feed\/update\/urn:li:activity:7123624281334251520\">Modern\u00ed pr\u00e1vn\u00edci<\/a>, <a href=\"https:\/\/attorneyatcode.com\/cs\/data-driven-legal-design-class\/\">a legal innovation, tech, and design, data-driven course<\/a>. In terms of Generative AI, there is a significant rise in how sophisticated the students&#8217; final projects are becoming. While in December 2022, <a href=\"https:\/\/attorneyatcode.com\/cs\/lawyer-skills-ai\/\">we used ChatGPT to create study plans<\/a>, in December 2023 students were using it to prep code for a full website or geographical data visualization, completely on their own. In this case, Generative AI has unequivocally been a hyperdrive.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Legal Design: journey to maturity<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>The <a href=\"https:\/\/attorneyatcode.com\/cs\/legal-design-thinking\/\">Legal Design<\/a> tribe has been summoned this year to the <a href=\"https:\/\/www.linkedin.com\/posts\/barboraobracajova_lds2023-activity-7109546544000880641-U1fD?utm_source=share&amp;utm_medium=member_desktop\">Legal Design Summit in Helsinki<\/a>.<\/strong> The rising number of voices, practitioners, and case studies indicated that the niche is alive and well. <strong>Among the speakers, there was still a dominance of consultants treating legal design as a product rather than in-house teams making it a long-term institutional phenomenon<\/strong>, an imbalance characteristic of the relatively new and attractive field that is all about experimenting. <a href=\"https:\/\/www.linkedin.com\/feed\/update\/urn:li:activity:7109102108917800960?updateEntityUrn=urn%3Ali%3Afs_feedUpdate%3A%28V2%2Curn%3Ali%3Aactivity%3A7109102108917800960%29\">Big Law showed up as sponsors, speakers, and audience<\/a>. <a href=\"https:\/\/johannesklingebiel.de\/wiki\/Design%20Notes\/post-its.html?fbclid=PAAaY4tJLSctqhn_kDwy7Qx-QdyqknR3lg7y1m5ZQN_hQHiDcSpn-XBEzPXpk_aem_AcnmuD3M5uf4lsB_auO_ky3i9KS2YZj3sZlTYaRn7qXXHmfFHoNCt-uiHsAdICb7cRs\">The notorious Post-it<\/a> has made an appearance more than a few times; <a href=\"https:\/\/attorneyatcode.com\/cs\/legal-operations\/\">legal operations<\/a> were barely mentioned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Everyone who is into making law a more enjoyable product had their hurrah moment when the\u2002<a href=\"https:\/\/www.iso.org\/standard\/78907.html\">plain language ISO standard<\/a> was issued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Finally, on this pathway towards maturity, the big news is the launch of the <a href=\"https:\/\/legaldesign-journal.com\">Legal Design Journal<\/a>, <strong>the first official academic journal with a focus specifically on Legal Design<\/strong>. As Michael Doherty, the new Editor-in-Chief described as <em>the place where you don&#8217;t have to dedicate the first half of your paper to explain, what legal design actually is<\/em>.
