This is Part III of a Legal Futures series.<\/em><\/p>\n\n\n\n

In Part I<\/a>, we established that there are always many possible futures, which we captured in scenarios in Part II<\/a>.<\/p>\n\n\n\n

But that is still fairly abstract, words on screen. Little to rally around.<\/p>\n\n\n\n

Enter design fiction<\/em>: create a story about what you see, and let me touch something from that future.<\/strong><\/p>\n\n\n\n

Black Mirror: Legal Tech Edition (except everyone seems to be having a relatively ok time)<\/h3>\n\n\n\n

Design fiction is having its moment in legal tech.<\/p>\n\n\n\n

As the industry is at an inflection point, many are attempting to reimagine what it will look like on the other side of the mirror. And fiction is a brilliant vessel to formulate the architecture of the not yet<\/em>.<\/strong><\/p>\n\n\n\n

Some recent examples of legal design fiction that I will be referencing below are the AI Native Firm by Daniel Martin Katz, Michael J. Bommarito II, and Jillian Bommarito<\/a>, Three Rooms by Dazza Greenwood<\/a>, Hargora<\/a>, and a 2030 vision from LegalQuants<\/a>. Interestingly, these are rather utopian futures where things rarely go really wrong (which I consider a signal in itself – keep reading why).<\/p>\n\n\n\n

A little bit of design theory<\/h3>\n\n\n\n

Design fiction was built as a field by the Near Future Laboratory, drawing on the work of Bruce Sterling and others.<\/p>\n\n\n\n

The ultimate point of design fiction is to produce believable diegetic prototypes, that is, fictional objects from an alternative future<\/strong> (as per The Manual of Design Fiction<\/a>).<\/p>\n\n\n\n

These artefacts have been IKEA-style catalogues<\/a>, YouTube unboxing videos, fictional newspapers, products<\/a>, a whole convenience store<\/a>, and in general any medium that makes the future tangible and imaginable.<\/p>\n\n\n\n

Good design fiction has established mechanics, characters, items. For example, Hargora had a merger announcement, careers page, and merch, LegalQuants vision of 2030 has its token committee meeting.<\/p>\n\n\n\n

While we are working in the future, the story does not deal with heroes and spaceships, but rather with the background everyday characters and their everyday items. Or as Nick Foster calls it, the future mundane<\/a>.<\/em><\/p>\n\n\n\n

In legal tech design fiction, it means that there are issues, testing protocols, paralegals, and government agencies, but also regular humans with actual relationships, and – as things usually go in law – Microsoft Word.<\/p>\n\n\n\n

You did not bid a procurement now with a document of promises. You bid it with a thing that ran. The state defined the project and published the scoring rubric, and every team built the working bones of it and submitted them into a secure evaluation room. Your own agent could go into that room and test your build against the rubric and bring back verified results; it could not see or carry out one line of anyone else\u2019s code.”<\/p>\n\n\n\n

There should be stuff that is outdated (old USB-C flash drive you need to use) and\/or broken (government platform that requires you to convert to PDF).<\/p>\n\n\n\n

In lawyer stories, it also often involves half-eaten dinners and cold coffee (my theory is that this bit comes from large language models who see lawyers largely as cranky hangry humans eating over keyboards).<\/p>\n\n\n\n

What is it good for?<\/h3>\n\n\n\n

As I noted in the previous parts, it is notoriously hard to predict the future.<\/p>\n\n\n\n

Therefore, design fiction artefacts should not be read as predictions, but rather as material that we can work with in the following ways.<\/p>\n\n\n\n

First of all, we can hold a conversation about a fully fledged world<\/strong>.<\/p>\n\n\n\n

If I wanted to discuss dark magic, we would first have to agree on a lot of basic premises.<\/p>\n\n\n\n

Compare it to how much easier it is to argue about the mechanics of post-Voldemort conflict resolution in the world of Harry Potter<\/a>.<\/p>\n\n\n\n

Now replace “dark magic” with “AI native law firm” <\/strong>– we can argue about the very definition of the term OR we can discuss the economics of the fictional AI native firm Candor that Sarah built in the book of the same name<\/a>.<\/p>\n\n\n\n

Za druh\u00e9, fiction can shape what gets built<\/strong>. If you have a specific image, it is easier to go ahead and build the scaffolding to make it a reality. Once an image enters people’s minds, things can seem more feasible. Like when Nike created futuristic self-lacing sneakers first for the movie Back to the Future – and then for real.<\/a><\/p>\n\n\n\n

The vision also serves as a signal in itself.<\/strong> If someone like Dazza, Dan, or LegalQuants, all ultimate insiders at the very cutting edge of legal innovation with tons of agency and having their own bets on the trajectory, say they see things going a certain way, it can point to where money, attention, and hopes are going. And presenting positive visions of the futures fits into the brand.<\/p>\n\n\n\n

In other words, a future is not neutral, the image will always be shaped by who has authored it.<\/p>\n\n\n\n

Futures are multiple and borderline impossible to predict, but we can illustrate the different scenarios with things from these alternative realities.<\/strong><\/p>\n\n\n\n

Ultimately, the point is not to identify the correct future, but rather to define what kind of future we wish to create and what we would like to avoid.<\/p>\n\n\n\n

To imagine what would happen if it went well.<\/p>\n\n\n\n

And if it didn’t. If the system got corrupted, the agent went rogue, the procurement took three years, and the people around it just did not wish to change.<\/p>\n\n\n\n

Design fiction brings an artefact that becomes a conversation that can become agency.<\/strong><\/p>\n\n\n\n
